Envío Cero / The Correspondence Almanac

DMCA

A letter can carry one person’s writing, another person’s photograph and a third person’s transcription. A copyright concern about enviocero.com is easier to assess when it identifies the particular work and the particular use, rather than only the object depicted.

Prepare a comparison

Use Contact with “Copyright review” at the beginning of the message. Give the exact URL on this site, the passage or image at issue, a description of your protected work and a reliable location where it can be identified. Explain whether you are the rights holder or authorised to act for them. Include a reply method. The form takes text, so provide reference links rather than private files.

If you are invoking the DMCA

A notice intended to satisfy United States law under 17 U.S.C. §512(c)(3) generally needs:

  • Your physical or electronic signature as owner or authorised representative.
  • Identification of the copyrighted work, or a representative list where several works are involved.
  • Identification and a reasonably sufficient location of the material you want removed or access to which you want disabled.
  • Information reasonably sufficient to contact you, including the contact particulars required for a statutory notice.
  • A statement of your good-faith belief that the disputed use is not authorised by the owner, its agent or the law.
  • A statement that the notice is accurate and, under penalty of perjury, that you are authorised to act for the owner of the exclusive right concerned.

This page supplies a contact route for review; it does not claim that a designated DMCA agent has been registered. If a formal statutory process is needed, applicable legal requirements and the hosting provider’s published process may also matter. Obtain legal advice if uncertain about a notice or an exception.

Keep the enclosure proportionate

Send only information needed to identify the rights issue. A request may be shared with a host, an affected contributor or advisers where necessary to investigate or respond, including contact details where legally required. Unrelated private correspondence should stay out of the notice. Copyright review is not the right route for a mere disagreement with an opinion or a factual correction.

Disputed removals

If you believe material was restricted in error, identify it through Contact and explain the authorisation, ownership or legal exception you rely on. A formal counter-notification may require additional statements, contact information and jurisdictional consent under applicable law; it may be forwarded to the claimant. No restoration timetable or legal outcome is promised here. Knowingly material misrepresentations in statutory notices can have legal consequences.
